Please read these Terms carefully before creating an account or purchasing any product on this Platform. By registering or making a purchase, you confirm that you have read, understood, and agreed to these Terms in fullSection 1 — About TACT and This Platform
Who we are, what this Platform is for, and who these Terms apply to.
1.1 Thrive Advance Consultancy & Training (Pvt) Ltd (“TACT”) is a company registered in Sri Lanka. TACT designs and delivers financial crime compliance learning programmes and professional development workshops for individuals and organisations. TACT’s learning management system (“LMS”) platform is hosted on LearnWorlds and accessible at https://tact.learnworlds.com/home (the “Platform”).
1.2 The Platform serves as the primary delivery vehicle for all TACT learning products, including multi-module certification preparation programmes, standalone professional development workshops, and any other learning products that TACT may make available from time to time.
1.3 These Terms & Conditions of Platform Use (“Terms”) govern access to and use of the Platform by every individual who creates an account, browses the Platform, or purchases any product offered through it, regardless of which programme or workshop they enrol in.
1.4 By creating an account on the Platform or purchasing any product through it, you (“the User”) agree to be bound by these Terms in full. If you do not agree to these Terms, you must not create an account or make any purchase.
1.5 These platform-level Terms operate alongside any product-specific terms that apply to individual programmes or workshops. Where both apply, the product-specific terms govern on matters specific to that product; these Terms govern all other matters. In the event of any direct conflict, the more specific terms prevail.Section 2 — Account Registration &
Eligibility
Who can create an account, what is required, and how to keep your account secure.
2.1 To access paid content on the Platform, you must create a user account. To create an account, you must: (a) be at least 18 years of age; (b) provide accurate, complete, and current information at the time of registration; and (c) maintain and update that information as necessary to keep it accurate. TACT does not knowingly permit minors under the age of 18 to register accounts. If TACT becomes aware that a minor has registered, that account will be closed without notice.
2.2 Each individual may hold only one account. Accounts are personal and non-transferable. You must not create an account on behalf of another individual without their knowledge and consent.
2.3 You are responsible for maintaining the confidentiality of your account login credentials. You must not share your password or login details with any other person. Any activity that occurs under your account is your responsibility, whether or not it was authorised by you.
2.4 If you become aware of any unauthorised access to your account or any other breach of account security, you must notify TACT immediately at info@tactsolutionslk.com. TACT will take reasonable steps to assist you, but accepts no liability for loss or damage arising from your failure to keep your credentials secure.
2.5 TACT reserves the right to suspend or terminate any account at any time, with or without notice, where TACT reasonably believes that the User has breached these Terms or has engaged in conduct that is harmful to TACT, other users, or third parties. Suspension or termination does not automatically entitle the User to a refund — refund eligibility in such circumstances is governed by Section 6 of these Terms and any applicable product-specific terms.
Section 3 — Products Available on the Platform
What you can purchase through this Platform, including current and future products.
3.1 The Platform currently hosts the following categories of learning products:
- Certification Preparation Programmes: Structured multi-module programmes designed to prepare participants for professional certification examinations. FINCRIME MASTERY™ — TACT’s flagship 4-month CFCS certification coaching programme — is the primary example of this product type, combining live and virtual instructor-led sessions with self-paced micro-learning modules.
- Pocket Workshops: Standalone professional development workshops, each approximately 3 hours in duration, focused on specific financial crime compliance topics. Topics currently offered or planned include SAR/STR Writing, KYC & CDD, Transaction Monitoring, Beneficial Ownership, Sanctions, Cybercrime, DNFBP-Specific Compliance, and others as added over time. Each Pocket Workshop is an independent, paid product.
- Other Learning Products: TACT may make additional programmes, workshops, micro-learning modules, or resources available on the Platform from time to time. These Terms apply to all such products unless a separate product-specific agreement is provided and signed.
3.2 Each product available on the Platform has its own specific terms covering pricing, access duration, refund policy, and any other product-level conditions. These specific terms are communicated to you at the point of purchase and, once agreed, form part of the overall agreement between you and TACT together with these platform-level Terms.
3.3 TACT reserves the right to add, modify, withdraw, or discontinue any product or product category at any time. Where TACT withdraws a product to which you have already been granted access and for which you have paid, TACT will offer you either a refund or equivalent alternative access at its discretion.Section 4 — Purchasing & Payment
How purchases work, what we accept, when your access begins, and how invoicing works.
4.1 All purchases on the Platform are processed in accordance with the payment methods and currency rules described in this Section. TACT invoices issued to you constitute the binding record of any purchase made.
4.2 TACT accepts payment by the following methods: (a) online credit or debit card payment via the Payable payment gateway (payable.lk), which accepts Visa and Mastercard; and (b) bank transfer to TACT’s designated bank account, details of which are provided on the relevant invoice. Additional payment methods may be introduced or withdrawn from time to time at TACT’s discretion.
4.3 Currency: Fees for domestic Sri Lanka-based users are quoted and payable in Sri Lankan Rupees (LKR). Fees for international or diaspora users are quoted and payable in United States Dollars (USD). The applicable currency for your purchase will be indicated at the point of sale. Where a user based outside Sri Lanka chooses to pay in LKR (for example, via a Sri Lankan bank account), the prevailing LKR rate applies and payment must be made by bank transfer.
4.4 Platform access for any purchased product is granted upon confirmation of payment receipt by TACT — not upon submission of an enrolment form, registration of interest, or any other preliminary step. No access will be granted until payment has been received and confirmed in full.
4.5 Prices displayed on the Platform are correct at the time of display. TACT reserves the right to change pricing for future cohorts, programmes, or new products at any time. Price changes do not affect purchases already confirmed and invoiced.
4.6 Any applicable taxes or levies will be clearly indicated at the point of purchase. Prices stated are inclusive of any applicable taxes unless explicitly stated otherwise.
4.7 Where a User’s employer or institution (“Sponsor”) is funding the User’s enrolment, TACT will issue the invoice in the Sponsor’s name upon request. The Sponsor accepts joint financial responsibility for all fees payable. The User remains bound by all non-financial obligations under these Terms and any applicable product-specific terms.
Section 5 — Access, Duration & Availability
Section 5 — Access, Duration & Availability
When your access begins and ends, and what happens if the Platform experiences downtime.
5.1 Platform access for each purchased product begins on the date of payment confirmation and continues for the access period applicable to that product, as set out at the point of purchase. The following access periods apply by default, subject to any product-specific terms confirmed at purchase:
- FINCRIME MASTERY™ (Certification Preparation Programme): Access is granted for the full 4-month programme duration from cohort commencement, plus a 30-day post-programme access window for revision purposes. Access to session recordings and self-paced modules during this window is subject to Clause 5.3.
- Pocket Workshops (Standalone 3-Hour Sessions): Access is granted for 60 days from the date of the workshop or, for recorded sessions, from the date the recording is made available to the User.
- Other Learning Products: Access periods for any other product types will be specified at the point of purchase.
5.2 TACT may, at its sole discretion, extend a User’s access period. No extension is guaranteed unless offered in writing by TACT.
5.3 Session recordings, where provided, are available exclusively to enrolled Users via the Platform for the duration of their active access period. Recordings may not be downloaded, shared, or accessed outside the Platform environment. This is consistent with TACT’s programme-specific access and recording policy.
5.4 TACT will use reasonable efforts to ensure Platform availability at all times. However, TACT is not liable for Platform downtime or service interruptions caused by: (a) technical issues within LearnWorlds’ infrastructure or other third-party providers; (b) scheduled maintenance, of which TACT will give Users reasonable advance notice where practicable; or (c) circumstances beyond TACT’s reasonable control, including but not limited to internet outages, cyberattacks, natural disasters, or force majeure events.
5.5 Where Platform downtime or a technical failure directly causes a User to miss a live session or time-sensitive content, TACT will take reasonable steps to mitigate the impact — for example, by making a recording available or rescheduling the affected session. TACT’s liability in such circumstances is limited as set out in Section 13Section 6 — Refund & Cancellation Policy
When you can get a refund, how to request one, and what happens if TACT cancels a session.
6.1 FINCRIME MASTERY™ Refunds: The refund and cancellation policy for the FINCRIME MASTERY™ programme is governed in full by the TACT Terms & Conditions & Student Agreement applicable to that programme. 6.2 Pocket Workshop Refunds: Given the short duration and digital delivery nature of Pocket Workshops, the following refund policy applies:
- Full refund if cancellation is requested within 48 hours of registration. The refund will be processed within 5 working days of TACT receiving the written cancellation request, minus any bank charges or payment gateway fees incurred by TACT in processing the original transaction and the refund.
- No refund is available after 48 hours of registration.
- No refund is available once the workshop has commenced. For recorded sessions, access to the recording by the User constitutes commencement of the workshop.
6.3 Self-Paced Digital Products: For any self-paced digital product that TACT may add to the Platform in the future — where the product consists of pre-recorded content — no refund will be available once the User has accessed the content.
6.4 TACT Cancellation of a Live or Virtual Session: Where TACT cancels any scheduled live or virtual session, TACT will offer each affected User either a full refund of the fee paid for that session or the opportunity to reschedule to an equivalent future session, at the User’s election. TACT’s liability in such circumstances does not extend beyond this offer.
6.5 All refund requests must be submitted in writing to info@tactsolutionslk.com. Refunds, where approved, will be processed within the timelines stated in this Section. Where no specific timeline is stated, refunds will be processed within 14 working days of approval by TACT.Section 7 — Intellectual Property
All Platform content belongs to TACT. You have a limited personal licence to access it — nothing more.
7.1 All content available on the Platform — including session recordings, presentation slides, case studies, workshop materials, assessment questions, micro-learning modules, scenario-based exercises, written guides, and any other learning materials — is the intellectual property of TACT or, where applicable, its licensors. All rights are reserved.
7.2 By purchasing a product on the Platform, TACT grants you a limited, non-exclusive, non-transferable, revocable licence to access and use that content solely for your own personal professional development during your active access period. This licence does not include any right to download, copy, reproduce, share, redistribute, resell, or create derivative works from any Platform content.
7.3 Without TACT’s prior written consent, you must not: (a) download, screen-record, screenshot, or otherwise reproduce any Platform content in any form; (b) share your account access or Platform content with any other person; (c) use any Platform content for any commercial purpose, including training others or creating competing products; (d) remove, alter, or obscure any copyright, trademark, or proprietary notice on any Platform content.
7.4 Violation of this Section may result in: immediate termination of your account without refund; demand for compensation for damages suffered by TACT; and/or legal proceedings under applicable intellectual property law. TACT takes violations of its intellectual property rights seriously and will act accordingly.
7.5 The TACT name, logo, tagline (“Where Growth Meets Guidance”), FINCRIME MASTERY™, and all related marks are proprietary to TACT. You must not use them in any way without TACT’s prior written consent.Section 8 — Acceptable Use & Prohibited
Conduct
What you are not permitted to do on this Platform — read this carefully.
8.1 By using the Platform, you agree that you will not:
- Share your login credentials, account access, or Platform content with any other person under any circumstances.
- Use the Platform or its content for any commercial purpose — including reselling, sub-licensing, or training others — without TACT’s prior written consent.
- Attempt to bypass, hack, circumvent, or tamper with any Platform security feature, access control, or digital rights protection mechanism.
- Use any automated tool, bot, scraper, or similar technology to access, extract, or copy Platform content.
- Post, upload, or transmit any content through the Platform that is defamatory, harassing, unlawful, fraudulent, or in violation of any applicable law.
- Impersonate TACT, Rochelle Gabriel, Greshan Gabriel, or any other person, whether on the Platform or in any communication connected to it.
- Use any knowledge, content, or materials derived from the Platform in a manner that facilitates, enables, or assists any act of financial crime — including but not limited to money laundering, terrorist financing, fraud, corruption, or sanctions evasion. This prohibition is fundamental to TACT’s purpose and reflects TACT’s professional and moral responsibility as a financial crime compliance training provider.
8.2 Platform users are subject to the same moral and professional integrity standard that applies to enrolled FINCRIME MASTERY™ participants under the Student Due Diligence clause in TACT’s programme-specific Terms. By creating an account, you confirm that you are accessing this Platform for a legitimate professional, academic, or personal development purpose and that you are not doing so in furtherance of any unlawful activity.
8.3 TACT reserves the right to suspend or terminate, without prior notice, the account of any User who, in TACT’s reasonable assessment, has breached or is at risk of breaching any provision of this Section. In serious cases, TACT reserves the right to report relevant information to applicable regulatory or law enforcement authorities.
8.4 Where a User submits any communication or content to TACT through the Platform, the User acknowledges that TACT may review such communications for quality assurance and compliance purposes, and waives any moral right to be identified as the author of such communications in the context of TACT’s internal use thereof.Section 9 — Completion Certificates & CPD
Records
What TACT’s certificates confirm — and what they do not guarantee.
9.1 TACT issues digital completion certificates via the Platform for programmes and workshops where a certificate is included as part of the product. A certificate will be issued upon satisfactory completion of the relevant programme or workshop in accordance with its completion requirements.
9.2 TACT completion certificates confirm that the named individual has completed the relevant TACT programme or workshop. They do not: (a) confer the CFCS designation or any other professional qualification; (b) constitute ACFCS-accredited or ACFCS-approved content unless TACT’s Authorised Training Provider (ATP) status with ACFCS is explicitly confirmed and stated in the relevant product description; or (c) guarantee recognition by any employer, regulator, professional body, or CPD scheme.
9.3 TACT is not responsible for any decision by any employer, regulator, professional body, or other authority to recognise or decline to recognise a TACT completion certificate for any purpose, including CPD credit, promotion, licensing, or registration.
9.4 Users are responsible for maintaining their own CPD records. TACT’s completion certificates are intended to serve as supporting documentation for CPD purposes. They do not substitute for the User’s own record-keeping obligations.
9.5 Certificates are issued in the name of the registered account holder. TACT will not reissue certificates in a different name or alter certificate details after issuance without clear evidence of a genuine administrative error on TACT’s part.Section 10 — CFCS Examination — Separation of
Services
TACT’s programmes prepare you for the CFCS exam — they are not the exam, and TACT does not control ACFCS.
10.1 IMPORTANT: FINCRIME MASTERY™ and any other TACT programme related to CFCS preparation are preparation and coaching programmes only. They are not the CFCS examination and are not sold as examination registration.
10.2 The Certified Financial Crime Specialist (CFCS) designation is owned by and awarded exclusively by the Association of Certified Financial Crime Specialists (ACFCS), an independent international body. TACT is not ACFCS and has no authority over ACFCS.
10.3 TACT has no control over and accepts no responsibility for: (a) ACFCS examination scheduling, format, or content; (b) ACFCS eligibility requirements or decisions on individual applicants; (c) ACFCS examination fees or registration processes; (d) the outcome of any CFCS examination; or (e) any change ACFCS makes to the CFCS designation, syllabus, or eligibility criteria.
10.4 TACT operates in association with ACFCS in developing and delivering CFCS preparation content. TACT’s content is not designated as ACFCS-certified or ACFCS-approved material unless explicitly and separately confirmed in writing in the relevant product description. Any reference to TACT’s relationship with ACFCS in product materials should be read in light of this clause.
10.5 A User who completes a TACT CFCS preparation programme will still need to separately register for, pay for, and sit the CFCS examination directly with ACFCS in order to obtain the CFCS designation. TACT will provide guidance on the examination registration process where possible, but this guidance is informational only.Section 11 — Data Protection & Privacy
What data we collect, how we use it, who we share it with, and your rights.
11.1 TACT collects and processes the following personal data from Platform users: (a) account registration data, including full name, email address, contact details, and organisation or institution; (b) purchase history and invoice records; (c) learning progress data generated through the LearnWorlds platform, including module completion, assessment results, and engagement analytics; and (d) payment transaction records processed through the Payable gateway.
11.2 TACT uses this data for the following purposes: (a) account creation, management, and authentication; (b) delivery of purchased programmes and workshops; (c) payment processing and financial reconciliation; (d) issuing completion certificates; (e) communicating with users about their enrolment, upcoming sessions, and platform updates; and (f) internal quality assurance and programme improvement.
11.3 TACT will not sell your personal data to any third party. TACT may share your data only in the following circumstances: (a) with Payable (payable.lk) for the purpose of processing your payment transactions — Payable’s own privacy terms apply to data held by them; (b) with ACFCS, but only in aggregate or anonymised form unless you expressly consent to the sharing of individual data; (c) with LearnWorlds as TACT’s platform hosting provider — LearnWorlds processes user data as a data processor on behalf of TACT; and (d) as required by applicable law, court order, or regulatory authority.
11.4 Users have the following rights in relation to their personal data held by TACT: (a) the right to request access to their data; (b) the right to request correction of inaccurate data; and (c) the right to request deletion of their data, subject to TACT’s legal obligations to retain certain records. Requests should be directed in writing to info@tactsolutionslk.com. TACT will respond within a reasonable time.
11.5 TACT retains user account and purchase records for a minimum of 3 years following the date of last Platform activity. This retention period reflects TACT’s quality assurance obligations and is consistent with TACT’s programme-specific data retention policy.
11.6 TACT’s Privacy Policy, which provides further detail on how your personal data is handled, is available at: https://tactsolutionslk.com/privacy-policy/. Users are encouraged to review this policy. The LearnWorlds platform also operates its own data infrastructure, and data held on the LearnWorlds platform is subject to LearnWorlds’ own data processing terms in addition to TACT’s obligations.Section 12 — Third Party Links & Tools
We sometimes link to external resources for your convenience — but we are not responsible for them.
12.1 The Platform may contain links to third-party websites and resources, including the ACFCS website, FATF publications, the FIU Sri Lanka, CBSL regulatory materials, and other reference resources relevant to financial crime compliance. These links are provided for the convenience and professional development of users only.
12.2 TACT does not endorse, control, or take responsibility for the content, accuracy, availability, or privacy practices of any third-party website or resource. Accessing any third-party link from the Platform is done entirely at the User’s own risk.
12.3 The inclusion of a link to any third-party resource does not imply a partnership, endorsement, affiliation, or any other relationship between TACT and the operator of that resource.
12.4 Third parties wishing to link to the Platform homepage may do so without prior permission. Deep links to specific pages or content within the Platform require TACT’s prior written consent. Requests should be directed to info@tactsolutionslk.com.
Section 13 — Limitation of Liability
How TACT’s liability is capped, and what we are not responsible for.
13.1 To the fullest extent permitted by applicable law, TACT’s total liability to any User arising out of or in connection with these Terms, the Platform, or any product purchased through the Platform shall not exceed the total fees paid by that User in respect of the specific product to which the claim relates.
13.2 TACT is not liable for: (a) any decision by ACFCS or any other body regarding a User’s examination application, eligibility, or result; (b) any career, employment, or professional outcome of a User following completion of any TACT programme or workshop; (c) any decision by an employer, regulator, or professional body not to recognise a TACT completion certificate; (d) technical failures, service interruptions, or data loss attributable to LearnWorlds’ infrastructure or other third-party service providers; (e) Platform unavailability or disruption due to force majeure events, including but not limited to natural disasters, governmental actions, cyberattacks, or network failures; or (f) any indirect, consequential, special, or economic loss of any kind, even if TACT has been advised of the possibility of such loss.
13.3 Nothing in these Terms limits or excludes TACT’s liability for: (a) death or personal injury caused by TACT’s negligence; (b) fraud or fraudulent misrepresentation by TACT; or (c) any liability that cannot lawfully be limited or excluded under the laws of Sri Lanka.
13.4 The limitations in this Section reflect a fair and reasonable allocation of risk between TACT and its Users, taking into account the nature of the Platform, the pricing of TACT’s products, and the factors within and outside TACT’s reasonable control.Section 14 — Amendments to These Terms
We can update these Terms — but we will give you notice and you always have the option to close your account.
14.1 TACT may update these Terms at any time. TACT will notify Users of any material change by email to their registered account email address. Material changes will not take effect for a minimum of 14 days following the date of notification, giving Users a reasonable opportunity to review the updated Terms before they become binding.
14.2 Your continued use of the Platform after the 14-day notice period has elapsed constitutes your acceptance of the updated Terms. If you do not accept the updated Terms, you must immediately stop using the Platform and contact TACT at info@tactsolutionslk.com to request closure of your account.
14.3 TACT may make minor or non-material updates to these Terms — for example, to correct typographical errors or update contact details — without prior notice. The current version of these Terms is always available on the Platform and replaces all prior versions.
14.4 Where a material amendment directly affects a User’s access to a product for which they have already paid, TACT will take reasonable steps to ensure that the User’s paid access rights are not materially prejudiced by the change.Section 15 — Governing Law & Dispute
Resolution
Sri Lanka law governs. We would rather resolve any issue by talking first.
15.1 These Terms are governed by and construed in accordance with the laws of Sri Lanka.
15.2 In the event of any dispute arising out of or in connection with these Terms or your use of the Platform, both parties agree to first attempt resolution in good faith through direct written communication. A party wishing to raise a dispute should write to info@tactsolutionslk.com setting out the nature of the dispute and the outcome sought.
15.3 If direct communication does not resolve the dispute within 30 days of the initial written notice, the matter may be referred to mediation under the laws of Sri Lanka before either party initiates formal legal proceedings. This is consistent with TACT’s dispute resolution approach across all its legal agreements.
15.4 If mediation fails or is not agreed upon, the courts of Sri Lanka shall have exclusive jurisdiction over any dispute that cannot be resolved by the above means. By using this Platform, you irrevocably submit to the jurisdiction of the courts of Sri Lanka.
Section 16 — General
Legal housekeeping — severability, waiver, language, assignment, and how to contact us.
16.1 Entire Agreement: These platform-level Terms, together with any product-specific terms communicated and agreed at the point of purchase, constitute the entire agreement between TACT and the User in relation to the Platform and the relevant product, and supersede all prior representations, communications, or understandings.
16.2 Severability: If any provision of these Terms is found by a court or competent authority to be invalid, unenforceable, or unlawful, that provision will be severed from the remaining Terms, which will continue in full force and effect.
16.3 Waiver: TACT’s failure to enforce any right or provision under these Terms on any occasion does not constitute a waiver of that right or provision and does not prevent TACT from enforcing it on any future occasion.
16.4 No Previous Terms Prevail: In the event of any conflict between these Terms and any prior version thereof, the provisions of these Terms shall prevail unless expressly stated otherwise.
16.5 Language: These Terms are written in English. In the event of any translation into another language, the English version prevails in all cases.
16.6 No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between TACT and any User.
16.7 Assignment: TACT may assign or transfer its rights and obligations under these Terms without notice in connection with a corporate restructure, merger, or sale of all or substantially all of TACT’s assets. Users may not assign or transfer any of their rights or obligations under these Terms without TACT’s prior written consent.
16.8 Third Party Rights: Nothing in these Terms shall confer any rights upon any third party. The agreement created by these Terms is between you and TACT only.
